GreeneHurlocker Client CFS Receives Final Zoning Approval for World’s First Grid-Scale Commercial Fusion Power Plant

On September 17, 2025, the Chesterfield County Board of Supervisors granted final zoning approval for GreeneHurlocker client Commonwealth Fusion Systems’ (CFS) ARC facility, clearing the way for construction of a first-of-its-kind grid-scale commercial fusion power plant. ARC will be located at 1201 Battery Brooke Parkway in Chesterfield County and is expected to generate 400 megawatts of electricity.

 

GreeneHurlocker is proud to represent CFS as regulatory, land use, and transactional counsel for this historic initiative. In a Richmond Times-Dispatch article reporting the news, GreeneHurlocker partner Ann Neil Cosby, who led the zoning process, commented, “A few months ago, few people knew what fusion was, including myself. Now, Chesterfield County, Virginia, is poised to become a leader in the commercial advancement of this new energy technology.” Ann Neil, Brian Greene, and Andy Brownstein are leading the team supporting CFS.

 

In addition to its potential to produce significant new clean energy for Virginia, the project is expected to generate hundreds of construction and permanent jobs for the Richmond region. Chesterfield County and the Virginia Clean Energy Innovation Bank have each provided $1 million grants to support the facility’s development. 

 

A Milestone Moment

With the conditional use permit now secured, site use is formally designated for the fusion power plant and its accessory facilities, which will include a power building, cooling towers, storage tanks, switchyard, administration building, and maintenance facility.
